The ruling from the lower court is due on Wednesday.
The justices of the Supreme Court allowed the reinstatement order from District Judge Amy Berman Jackson retaining Special Counsel Hampton Dellinger in his position until it expires on Wednesday. President Donald Trump’s administration had requested the Supreme Court lift the order after removing the special counsel from office.
The Justice Department had filed the application to vacate the order, claiming Judge Jackson’s ruling an “unprecedented assault on the separation of powers.“
“Enjoining the President and preventing him from exercising these powers thus inflicts the gravest of injuries on the Executive Branch and the separation of powers,” the DOJ filing stated. “This Court should not allow lower courts to seize executive power by dictating to the President how long he must continue employing an agency head against his will.”
